1. Overview
HostingGuru respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and applicable European copyright directives, we will respond expeditiously to claims of copyright infringement committed using the Service.
This policy describes how copyright holders can submit takedown notices, how affected users can respond, and how we handle repeat infringers.
2. How We Handle Takedown Requests
When we receive a valid DMCA takedown notice, we will:
- Review the notice for completeness and validity.
- Notify the user who deployed the allegedly infringing content, providing details of the claim and the complainant's contact information.
- Give the user 2 business days to remove or modify the identified content voluntarily.
- If the content is not removed within 2 business days, disable access to or remove the identified material.
- If a valid counter-notification is received and no court action is filed by the complainant within 10-14 business days, restore the content.
3. Filing a Takedown Notice (For Copyright Holders)
If you believe that content hosted on HostingGuru infringes your copyright, you may submit a takedown notice to our designated agent. Your notice must include the following information, as required by 17 U.S.C. § 512(c)(3):
- Your full legal name, mailing address, telephone number, and email address.
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).
- Identification of the material you claim is infringing, with sufficient detail for us to locate it (e.g., URLs).
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Your physical or electronic signature.

Warning: Knowingly submitting a false or misleading takedown notice may result in liability for damages, including costs and attorneys' fees incurred by the alleged infringer or by HostingGuru.
4. Counter-Notification (For HostingGuru Users)
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:
- Your full legal name, mailing address, telephone number, and email address.
- Identification of the material that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the courts in your district (or, if outside the United States, any judicial district in which HostingGuru may be found), and that you will accept service of process from the complainant.
- Your physical or electronic signature.

Upon receiving a valid counter-notification, we will:
- Forward it to the original complainant (including your contact information).
- Restore the removed content within 10-14 business days, unless the complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
5. Repeat Infringer Policy
HostingGuru will, in appropriate circumstances and at our sole discretion, disable or terminate the accounts of users who are repeat infringers. We consider the following factors:
- The number of valid takedown notices received against the user.
- The nature and severity of the infringement.
- Whether the user has submitted valid counter-notifications.
- The user's overall compliance history.
